Welcome to BevBay. These Terms of Service (the "Terms") govern your access to and use of the BevBay website at bevbay.com and any related features (together, the "Service"), operated by BevBay ("BevBay," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
BevBay is a free price-comparison and product-discovery service for beverage alcohol (wine, spirits, and beer). We collect and display product listings, prices, and availability information published by third-party retailers, and we provide links to those retailers' own websites.
BevBay is not a retailer, seller, importer, distributor, or shipper of alcohol or any other product. We do not sell, offer to sell, take orders for, fulfill, ship, or deliver any product, and we hold no alcohol license. Every purchase you make is a transaction solely between you and the independent third-party retailer you choose, on that retailer's own website and subject to that retailer's terms. BevBay is not a party to, and has no responsibility for, any such transaction.
The Service concerns alcoholic beverages and is intended only for adults of legal drinking and purchasing age. By using the Service, you represent and warrant that you are at least 21 years old (or the legal age for purchasing alcohol in your jurisdiction, if higher) and that you will comply with all applicable laws. The Service is not directed to, and may not be used by, anyone under the legal drinking age.
Prices, availability, product details, taxes, fees, vintages, sizes, and other information shown on BevBay are supplied by third parties (retailers and their data feeds) and are provided for general informational and comparison purposes only. This information may be inaccurate, incomplete, out of date, or presented in error, and it can change at any time without notice.
BevBay does not guarantee the accuracy, completeness, timeliness, or availability of any listing or price. Always confirm the current price, availability, product details, and total cost (including taxes, fees, and shipping) directly on the retailer's website before making a purchase. The price you actually pay is set by the retailer at checkout, not by BevBay.
The Service contains listings for, and links to, websites operated by independent third parties. We do not control, operate, endorse, or assume responsibility for any third-party retailer or website, including its products, prices, content, availability, customer service, fulfillment, shipping, returns, privacy practices, or compliance with law. The inclusion of a retailer or listing on BevBay is not an endorsement, nor a representation that the retailer can lawfully sell or deliver to you. Any dealings you have with a third party are solely between you and that party.
The sale, purchase, shipment, and delivery of alcohol are heavily regulated and vary by country, state, and locality. BevBay makes no representation that any product may lawfully be sold, shipped, or delivered to your location, or that any retailer is licensed to serve you. You are solely responsible for knowing and complying with all laws that apply to you, including age, quantity, and shipping restrictions.
You agree to use the Service only for lawful, personal, non-commercial purposes. You may not, and may not permit anyone else to:
The Service — including its design, text, graphics, software, and the selection, arrangement, and compilation of the listings and data it contains — is owned by BevBay or its licensors and is protected by intellectual-property and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved. Product names, brand names, and trademarks shown on the Service belong to their respective owners; their appearance does not imply any affiliation with or endorsement by BevBay.
BevBay compiles product listings from feeds and information that retailers make available for aggregation. If you are a retailer and would like to correct, update, or remove your listings, please contact us at team@bevbay.com and we will address your request within a reasonable time.
The Service is currently provided free of charge to both consumers and retailers. We reserve the right to introduce fees for certain features in the future; if we do, we will make that clear before you are charged.
The Service uses cookies and third-party analytics (such as Google Analytics) to understand usage and improve the site. By using the Service, you consent to such use. We do not require you to create an account or provide personal information to browse. Information you voluntarily submit (for example, through our contact form) is used only to respond to you.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. BevBay does not warrant that the Service will be uninterrupted, secure, error-free, or that any information it provides is accurate or current.
To the fullest extent permitted by law, BevBay and its owners, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, any reliance on information obtained from the Service, or any transaction with a third-party retailer, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages. Because the Service is provided free of charge, our total liability to you for all claims relating to the Service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless BevBay and its owners and operators from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; the "Last updated" date above shows when they last changed. Your continued use of the Service after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the State of Connecticut and applicable U.S. federal law, without regard to conflict-of-law principles. You agree that any dispute relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Connecticut, and you consent to their jurisdiction.
